These Terms & Conditions apply to all work performed and materials supplied by Tri-Star Landscaping LLC (“Contractor”) pursuant to an estimate or quote (“Estimate”) provided to the customer (“Customer”). These Terms & Conditions are incorporated into and made part of the Estimate unless expressly modified in writing by Tri-Star Landscaping LLC.

By approving or otherwise accepting the Estimate, Customer acknowledges that Customer has reviewed and agrees to the Estimate and these Terms & Conditions. The approved Estimate and these Terms & Conditions together constitute the agreement between Contractor and Customer.

ESTIMATES & SCOPE OF WORK

Estimates are valid for 30 days from the date issued unless otherwise stated in the Estimate.

The contractor will perform the work specifically described in the approved Estimate. Work, materials, repairs, modifications, or services not specifically included in the Estimate are considered additional work and may result in additional charges.

If conditions discovered after work begins require additional labor, materials, equipment, or services that could not reasonably have been anticipated when the Estimate was prepared, Contractor will notify Customer when practicable. Additional work may require Customer approval and/or an amended Estimate before proceeding.

Changes requested by Customer after approval of the Estimate may result in additional charges and may affect the project schedule.

PROPERTY CONDITIONS & UNDERGROUND HAZARDS

Customer is responsible for informing Contractor before work begins of any known underground or concealed conditions that could interfere with the work, including but not limited to irrigation systems, private utility lines, drainage systems, septic or sewage components, invisible fencing, landscape lighting, cables, pipes, buried debris, stumps, or other obstructions.

Contractor is not responsible for damage to underground or concealed items that were not properly marked, identified, or disclosed to Contractor before work began, except to the extent caused by Contractor's negligence.

If undisclosed or unforeseen site conditions interfere with the work, Contractor may suspend work until the condition is corrected or may perform additional work as agreed with Customer. Additional labor, materials, equipment, or subcontractor costs required because of such conditions may be billed separately.

The Customer shall provide reasonable access to the property and, when necessary for the contracted work, access to water and electricity.

PROJECT SCHEDULING & DELAYS

The Contractor will make commercially reasonable efforts to perform the work within the anticipated time frame. Project dates and completion times are estimates unless expressly guaranteed in writing.

Contractor is not responsible for reasonable delays caused by weather, unsuitable ground conditions, material or equipment availability, supplier delays, utility issues, property conditions, acts of God, governmental restrictions, or other circumstances beyond Contractor's reasonable control.

MATERIALS

Materials delivered to the Customer's property for use in the project become the Customer's responsibility while located on the property. Contractor is not responsible for theft, vandalism, damage, or loss of materials after delivery when caused by circumstances outside Contractor's reasonable control.

Unused materials purchased or supplied by Contractor that are not included as materials purchased by Customer under the Estimate remain the property of Contractor and may be removed from the property upon completion or termination of the work.

Natural materials, including stone, mulch, soil, sod, seed, and plant material, may vary in color, size, texture, appearance, or other natural characteristics. Such variations are not considered defects.

LANDSCAPE MATERIALS – NO WARRANTY

Tri-Star Landscaping LLC does not provide a warranty or guarantee on any trees, shrubs, plants, flowers, sod, seed, or other living landscape materials supplied or installed by Contractor. All living landscape materials are provided and installed AS-IS, unless a specific written warranty is expressly included in the Estimate.

Once installed, Customer assumes responsibility for the proper care and maintenance of all living landscape materials, including but not limited to watering, irrigation, fertilization, pruning, mowing, pest and disease management, and protection from weather conditions.

Contractor is not responsible for the death, decline, damage, or failure of trees, shrubs, plants, sod, seed, or other living materials resulting from transplant shock, watering or irrigation conditions, drought, excessive rain, flooding, freezing temperatures, extreme heat or cold, storms, disease, insects, wildlife, pets, chemicals, improper maintenance, soil conditions, acts of God, or other conditions beyond Contractor's reasonable control.

No replacement of living landscape materials will be provided at Contractor's expense unless expressly agreed to in writing.

SITE RESTORATION & HARDSCAPE WORK

Landscape, drainage, irrigation, excavation, and hardscape projects may result in temporary disturbance to lawns, landscaping, soil, driveways, walkways, or other areas necessary to access and complete the work.

Unless restoration is specifically included in the Estimate, the Contractor is not responsible for restoring disturbed areas to their original condition.

If Customer requests additional restoration, grading, sod, seed, landscaping, or other repair work that was not included in the original Estimate, the work will be treated as an additional service and additional charges will apply.

OTHER WARRANTIES & THIRD-PARTY DAMAGE

Contractor does not warrant against damage, failure, or loss caused by circumstances outside Contractor's reasonable control, including but not limited to drought, excessive rain, flooding, freezing temperatures, extreme heat or cold, storms, acts of God, or improper maintenance.

Contractor is not responsible for damage to completed work caused by Customer, other contractors, utility companies, excavation, grading, construction, fence installation, concrete work, landscaping work, heavy equipment, vehicles, or other third-party activity occurring during or after Contractor's work.

Any warranty expressly provided in an Estimate applies only to the work specifically identified as warranted and is subject to the limitations stated in that Estimate.

PAYMENT TERMS

Unless otherwise stated in the Estimate, payment of the outstanding balance is due upon completion of the contracted work. Invoices are due no later than three (3) days after the invoice date.

For Estimates totaling $2,000 or more, a deposit equal to 50% of the approved Estimate is required before work will be scheduled or materials ordered unless otherwise agreed in writing. The remaining balance is due upon completion of the contracted work.

Additional work, materials, equipment, or services authorized during the project may be added to the final invoice.
